Regulations of consumer sales conducted as part of the kulkabransoletki.pl online store.

1. General provisions

1.1. These Regulations define the conditions for the sale of jewelry via the online store available at www.kulkabransoletki.pl.

1.2. These Regulations are a contractual standard in the field of consumer sales services made via the website.

2. Definitions

2.1. Customer - a natural person purchasing products via the website for purposes not related to business activity. In order to purchase Products via the website, the Customer must create a Customer Account in accordance with the provisions of the Website Regulations.

2.2. Customer Account - an account created on the Website, in accordance with the provisions of the Website Regulations, enabling the Client to use the services provided by the Seller via the Website.

2.3. Products - products sold by the Seller via the Website.

2.4. Regulations - these regulations, specifying the conditions for the sale of products via the website.

2.5. Website regulations - regulations, available on the website www.kulkabransoletki.pl, specifying the terms and conditions of using the Website.

2.6. Website - website www.kulkabransoletki.pl, used to provide services described in detail on this website, including in particular the sale of Products.

2.7. Seller - Oliwia Kupis running a business under the name Olivia Kupis Kulka ul. Traugutta 5 90-106 Łódź with the main place of business at the address: ul. Traugutta 5, Łódź NIP:731-182-95-43

2.8. Parties - the Seller and the Customer.

2.9. Agreement - a contract for the sale of Products concluded by the Customer and the Seller via the Website

2.10. Order - an offer submitted by the Customer to purchase Products presented on the Website.

3. Registration

3.1. Concluding contracts via the Website requires registration and creation of a Customer Account, as well as acceptance of the Website Regulations.

4. Sale of Products

4.1. The Seller provides services through the Website consisting in the sale of Products.

4.2. Submit an order:

4.2.1. The Customer orders Products using the functionalities of the Website available after logging in to the Customer Account.

4.2.2. After placing the order, the Customer receives an automatically generated e-mail confirming receipt of the Order by the Seller.

4.2.3. The Customer may withdraw from the placed Order until the conclusion of the Agreement.

4.2.4. The order is processed immediately, subject to the availability of the Products.

4.2.5. In the event of temporary unavailability of the Products, the Seller shall immediately, not later than within 14 days from the date of placing the Order, inform the Customer about the status of the Order, and the Customer has the option to decide to change the method of order fulfillment within 14 days of obtaining such information, by selecting:

I. waiting for the execution of the Order;

II. withdrawal from the Order;

III. the customer may also choose to partially execute the Order (in relation to the available Products) and partially withdraw from the Order or wait for the possibility of its implementation.

If the Customer does not make the above choice within 14 days from the information about the temporary unavailability of the Products, it is considered that he has withdrawn from the Order in its entirety.

4.2.6. In the event of permanent unavailability of the Products, the Seller informs the Customer about this fact within 14 days from the date of placing the Order and the Agreement is not concluded.

4.3. The conclusion and implementation of the Product Sales Agreement is carried out in accordance with the following rules:

4.3.1. The presentation of Products on the Website does not constitute an offer within the meaning of the provisions of the Civil Code.

4.3.2. When placing an order, the Customer submits an offer to purchase the product from the Seller.

4.3.3. An automatically generated message, described in sec. 4.2.2. does not constitute a declaration of acceptance of the offer.

4.3.4. The contract is concluded:

I. in the event that within 14 days from the date of placing the Order, the Seller does not provide the Customer with the information specified in paragraph 4.2.5 or 4.2.6 - upon expiry of that period;

II. in the event that the Seller provides the Customer with the information specified in paragraph 4.2.5 - when the Customer selects the method of order execution.

III. If the Customer pays the price of the Product and delivery costs before the deadlines indicated above, it is considered that the Agreement is concluded when the Customer makes the payment, and in the event of temporary unavailability of the goods specified in paragraph 4.2.5. The Customer has the right to exercise the rights set out in this paragraph (where the relevant provisions regarding the "Order" apply to the "Agreement"). In the event of permanent unavailability of the Products, the concluded Agreement is terminated. In the event of withdrawal or termination of the Agreement, the Seller shall immediately (not later than within 30 days from the date of conclusion of the Agreement) return the entire price paid to the Customer.

4.3.5. When concluding the Agreement for the sale of Products via the Website, the parties are bound by the prices of the Products and the delivery costs provided on the Website at the time of placing the Order by the Customer.

4.3.6. When placing an Order, the Customer selects the payment method:

I. COD payment on delivery;

II. payment by bank transfer,

International shipments can only be paid for by bank transfer.

4.3.7. If you choose payment by bank transfer, the delivery of the Products is made after receipt of the payment by the Seller. Failure to pay the Product price and delivery costs by the Customer within 14 days of placing the Order is considered as withdrawal from the Agreement.

4.3.8. The delivery of the Products is made in the manner chosen by the Customer, selected in the Order from among the delivery methods proposed by the Seller.

4.3.9. The date of receipt of the Product depends on the order processing time at the Seller (14 business days) and the delivery period (confirmed each time by the courier). Delivery is made by third parties and the deadline for its implementation depends on these entities. Delivery of foreign parcels via Poczta Polska is made with the delivery date specified by Poczta Polska; Due to Brexit, parcel delivery time may extend to 30 days. Any customs duty or VAT is covered by the customer.

4.3.10. The customer receives the receipt with the shipment or by e-mail.

4.3.11. The customer is obliged to check the condition of the shipment upon receipt. If it is found that the parcel is damaged or if it is suspected that it has been damaged, the Customer should draw up a damage report, containing a detailed description of the condition of the parcel, signed by the person delivering the parcel. Failure to comply with these obligations does not deprive the Customer of the rights under applicable law.

4.4. The prices given on the Website are gross prices and include value added tax (VAT).

4.4.1. In addition to paying the price of the Product, the Customer is obliged to pay the delivery costs, depending on the selected delivery method. The amount of delivery costs is made available by the Service Provider in such a way that the Customer can read it before choosing the method of delivery and placing an order.

4.5. The Seller reserves the right to make, at any time, without justification and without additional notice:

4.5.1. changes in the prices of Products presented on the Website and delivery costs (depending on remuneration costs charged by third parties), subject to section 4.3.5.;

4.5.2. introducing and withdrawing Products;

4.5.3. carrying out or canceling promotional campaigns and sales, as well as making changes to their conditions.

Changes made pursuant to sec. 4.5 do not apply to Orders placed before such change.

4.6. When placing an Order, the Customer may specify that he is interested in receiving a VAT invoice. Such an invoice is issued at the time of completion of the order (full or partial) and is sent together with the ordered Products.

4.7. The seller informs that a limited number of goods are intended for promotional sales and sales and orders are processed in the order in which confirmed orders for these goods are received, until the stocks covered by this form of sale are exhausted.

4.8. The Customer agrees to suggest Products based on an automated comparison of the Customer's previous purchases and the preferences of other Customers.

4.9. Right to withdraw from the Agreement

4.9.1. The contract concluded in accordance with the provisions of this chapter is a distance contract within the meaning of the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (hereinafter referred to as the "Act").

4.9.2. According to Art. 7 sec. 1 of the Act, the Customer has the right to withdraw from the concluded Agreement by submitting a written statement within 14 days from the date of conclusion of the Agreement. To meet the above deadline, it is enough to send a statement before the expiry of this deadline.

4.9.3. The Customer should immediately return the Product. The product should be returned in a non-deteriorated condition.

4.9.4. The Seller will refund the price of the Product paid by the Customer within 14 days from the date of receipt of the effectively submitted declaration of withdrawal from the Agreement.

4.9.5. The refund will be made in the same form in which the payment was made by the Customer. The customer may choose a different form of refund:

I. to the bank account indicated by the Customer in the statement of withdrawal from the Agreement or

II. by postal order to the address indicated by the Customer in the Order, unless the Customer indicates a different address in the statement of withdrawal from the Agreement.

4.10. Complaints.

4.10.1. In the event of the following in the Product: non-compliance with the contract, physical defects and damage caused during delivery, the Customer has the right to use the complaint procedure described below. To the extent not regulated in the provisions below, the provisions of the Act of July 27, 2002 on

Klienci dokonujący zakupów na stronie: www.kulkabransoletki.pl, której właścicielem jest  Olivia Kupis Kulka ul. Traugutta 5 90-106 Łódź z głównym miejscem prowadzenia działalności gospodarczej pod adresem:  ul. Traugutta 5 , Łódź NIP:731-182-95-43, mają możliwość otrzymania: Bransoletka KULKA o wartości 119 zł, Brelok KULKA o wartości 119 zł w przypadku spełnienia warunków określonych w pkt. 2.

Promocja prowadzona jest w Sklepie Internetowym www.kulkabransoletki.pl oraz Sklepie Stacjonarnym znajdującym się w Łodzi przy ulicy Traugutta 5.

2. Warunkiem otrzymania gratisu jest:

Aby otrzymać Bransoletkę KULKA należy dokonać zakupu produktów na kwotę min. 299 zł (bez kosztu dostawy) w Sklepie Internetowym lub Stacjonarnym KULKA.   

Aby otrzymać Bransoletkę KULKA oraz Brelok KULKA należy dokonać zakupu produktów na kwotę min. 499 zł (bez kosztu dostawy) w Sklepie Internetowym lub Stacjonarnym KULKA.   

Warunkiem koniecznym jest zapłata rachunku za zakupy gotówką, kartą płatniczą, przelewem, paypal lub poprzez dokonanie płatności przy odbiorze.  

* Do jednego paragonu/zamówienia przysługuje po jednej sztuce z wymienionych wyżej prezentów. Jeśli prosisz o połączenie zamówień w jedną wysyłkę, będą one traktowane jako jedno zamówienie i dostaniesz po jednej sztuce z wymienionych wyżej gratisów. 

3. Postanowienia końcowe.       

a) Organizator zastrzega sobie możliwość wyłącznie promocji w dowolnym momencie.        

b) Zmiana warunków otrzymania gratisu może nastąpić jedynie poprzez zmianę niniejszego Regulaminu. 

c) W przypadku odstąpienia od Umowy Sprzedaży lub zwrotu towaru w sklepie internetowym, Klient ma obowiązek zwrócić także prezent w stanie nienaruszonym.   

W przypadku zwrotu towaru z zamówienia, do którego dołączony był prezent o wartości Y, przysługujący od kwoty X Klient zobowiązany jest zwrócić także otrzymany prezent.

W przypadku zwrotu części towaru, jeśli kwota zakupu spadnie poniżej ceny X to Klient również jest zobowiązany do zwrotu otrzymanego prezentu.

W przypadku odmowy zwrotu prezentu, Sklep zwróci Klientowi kwotę pomniejszoną o wartość prezentu.
